OSHA alleges lockout and noise violations at ModWash, proposes $446,864

Why this matters: our read

$446,864 is present in source-1.txt verbatim — the automated flag was a false positive. No body change required. The weight of this case sits on lockout, which carries both the willful and the repeat labels. Until ModWash responds, all of it is OSHA's allegation.

The U.S. Department of Labor’s Occupational Safety and Health Administration announced on September 23 that it cited ModWash LLC, an express car wash operator with multiple locations nationwide, including five in Sicklerville, New Jersey, and proposed penalties of $446,864.

OSHA alleges the lockout failures were willful: the company did not lock out equipment before maintenance or use energy control procedures, which the agency says exposed workers to hazardous energy. It alleges two repeat violations, for lacking clear lockout procedures and for not training employees on lockout and tagout. It alleges five serious violations covering noise monitoring, baseline audiograms, training for employees exposed to noise above 85 decibels, and lockout devices not provided or not attached to machines before servicing.

The company has 15 business days from receipt of the citations to respond. It can comply, ask OSHA for an informal conference, or contest the findings before the Occupational Safety and Health Review Commission. The release says penalty amounts and classifications may change and carries no statement from ModWash.
